Warranties Service and Maintenance
Link Mechanical Services, Inc. shall warranty all parts and materials for 30* days after the date of service / maintenance or to the extent they are warranted by the supplier or manufacturer. Unless otherwise agreed in writing, labor is warranted for 30* days after the completion of service / maintenance, unless otherwise noted on work ticket / invoice. Only the equipment, systems and components that are part of the scope of work listed on the work ticket / invoice will be covered under this warranty.
*As of 12/01/2012, customers who are currently enrolled as Discount Comfort Club members prior to the date of service / maintenance OR become a Discount Comfort Club member with EZ-Pay on the same day as the service / maintenance is performed will have the standard warranty extended to 90 days. The customer must maintain their membership in order for this warranty extension to remain in effect.
Warranty work is performed during Link Mechanical Services, Inc. normal business hours. Warranty calls will be scheduled before NON Discount Comfort Club members and we guarantee an appointment will be scheduled in no later than two (2) business days. If the customer requests after hours service, they agree to pay the up-front quoted diagnostic service charge, unless they are a current Discount Comfort Club member. (Discount Comfort Club members will not be charged)
There are no warranties, written, oral, or otherwise which extend beyond the description of the original work and express warranties herein are in lieu of all other warranties, expressed or implied, including any warranties of merchantability or fitness for a particular use.
Link Mechanical Services, Inc. shall use ordinary care in performing all service and installations, but shall not be liable for:
1) Damage or loss resulting from corrosion: utility service companies, low voltage conditions, lightning, single phasing, or other electrical abnormalities, damage, loss or delays resulting from fire, explosion , flooding, the elements, labor troubles, or any other cause beyond Link Mechanical Services, Inc. control.; failure to discover a condition requiring repair of replacement; improper operation or misuse of equipment by the customer, customer’s tenants, agents or employees; replacements or repairs caused by negligence by others, abuse, misuse, or by any other cause beyond the control of Link Mechanical Services, Inc., including faulty design of the equipment of system.
2) Injuries to persons, damage to property except those directly caused by the negligent acts of Link Mechanical Services, Inc. employees.
3) Loss of profits or other consequential damages even if Link Mechanical Services, Inc. has been advised of the possibility of such damages.
4) Any present or future taxes or charges of other governmental authorities.
5) Any items of equipment, labor, or special tests required or recommended by insurance companies, equipment vendors or governmental agencies.
